USER AGREEMENT

for the use of the web portal https://zeinride.com and Mobile App “Zain Car Captain”

1. GENERAL PROVISIONS

1.1. Using any function or Services of the Portal and Mobile App, any individual (hereinafter referred to as the “User”), irrespective of its legal status and civil capacity, is subject to the rules and restrictions specified in this User Agreement (hereinafter referred to as the “Agreement”).

1.2. The User gives its consent to obey all provisions of this Agreement during registration in the Portal or Mobile App. In case of disagreement with any provision of this Agreement the User is not allowed to use the Service of the Administrator.

1.3. The Administrator may amend, supplement or in any other way modify the Agreement without prior notification of a User.

1.4. The Agreement with all amendments and supplements is posted on the Portal and Mobile App. Hereby the User consents to amendments and alterations of the Agreement without receiving any special confirmation of User.

1.5. Following terms in the present Agreement shall have the following meaning unless the context requires otherwise:

Administrator — ZeinRide, the operator of the service and owner of the web portal https://zeinride.com and Mobile App “Zain Car Captain”.

Portal — web portal https://zeinride.com.

Mobile App — an application for mobile devices “Zain Car Captain” for Android and iOS.

User — any legally capable individual who is at least 18 (eighteen) years old at the moment of registration or duly registered legal entity who accepted the provisions of this Agreement and uses Services of the Portal and Mobile App.

Service — any operation, other than supply of goods, which is related to the provision of transportation services through the platform used to meet individual needs of the User.

Personal data — information or set of data about an individual who is identified or can be specifically identified with their use.

1.6. Additional terms of use of certain resources and Services can be specified on the Portal and Mobile App.

2. USER REGISTRATION

2.1. To use certain Services of the Portal and Mobile App the User is obliged to perform registration, resulting in creation of a unique account for the User to get access to the Services.

2.2. The User shall provide accurate information about oneself while filling in an application form during registration.

2.3. If the User provides false information during registration or later, within the use of Services, the Administrator has a right to suspend or terminate the account (registration) of the User without notice.

2.4. If the User’s actions may lead to a breach of any rules and regulations of applicable law, human rights or claims towards the Administrator, the Administrator has a right to block User’s actions immediately and suspend or delete the account of the User.

2.5. The Administrator undertakes to ensure necessary measures stipulated by applicable legislation to protect Personal Data transmitted to the Administrator during registration.

2.6. By registering on the Portal or Mobile App the User gives full, unconditional and irrevocable consent for use of Personal Data provided at registration.

2.7. The Administrator has a right to delete the User’s account if it is not used during 12 calendar months.

2.8. At registration the User shall enter a unique password. The User is fully responsible for the reliability of the password and protection of own account.

2.9. If a third party obtains access to User’s account, the User must immediately notify the Administrator.

2.10. The User ensures safety of information about passwords and other confidential information by himself. The Administrator is not responsible for the consequences of disclosure of such confidential information.

3. USE OF PORTAL AND MOBILE APP WITHOUT USER REGISTRATION

3.1. The User can use specific Services without registration.

3.2. Regardless of the fact of registration the User undertakes to comply with the terms of this Agreement while using the Services.

3.3. The Administrator has a right to restrict the use of certain Services without prior consent of the User.

3.4. If the User’s actions may lead to violation of applicable laws or rights of others, the Administrator has a right to block such actions immediately.

4. PERSONAL DATA

4.1. All issues regarding collecting, using, processing and protection of Users Personal data are regulated by a separate Privacy Policy placed on the Portal and Mobile App.

5. PORTAL AND MOBILE APP SERVICES

5.1. The Portal and Mobile App are intended to provide digital platform services connecting passengers with transportation service providers.

5.2. The Portal and Mobile App do not contain and are not intended for posting confidential or restricted information without authorization.

5.3. If Users detect information violating intellectual property rights they must contact the Administrator and report such violation.

5.4. The Administrator may involve third parties providing transportation services through the Portal and Mobile App.

5.5. The Administrator provides informational and promotional services only and does not guarantee the quality of transportation services provided by third parties.

5.6. Transportation services are provided based on agreements between Users and service providers. The Administrator is not a party to these agreements.

5.7. The Administrator is not responsible for timing, quality or performance of services provided by third parties.

5.8. Insurance: Transportation providers may provide insurance coverage where applicable according to local regulations.

6. LIMITS FOR SERVICES USE

6.1. The User guarantees that any content posted through the platform is lawful and does not violate rights of third parties.

6.2. The User agrees not to use the Services for transmission or posting of unlawful, threatening, defamatory, offensive or illegal content.

6.3. The Administrator does not verify all content posted by Users and bears no responsibility for its accuracy.

6.4. Users shall not distribute information that violates rights of third parties including personal data protection.

6.5. Users must comply with applicable laws of the country where the service is used.

6.6. Unauthorized advertising on the platform is prohibited.

6.7. The platform must not contain:

  • spam or unsolicited advertising
  • illegal software or hacking tools
  • pornographic material
  • offensive or abusive content
  • malware or harmful code

6.8. Materials downloaded through the platform are used at the User’s own risk.

6.9. The Administrator may request proof of rights for content posted by the User.

6.10. The Administrator may provide User information to authorized law enforcement authorities if required by law.

7. EXCLUSIVE RIGHTS

7.1. The Portal, Mobile App, source code, design elements and intellectual property belong exclusively to ZeinRide.

7.2. This Agreement does not grant Users rights to use the platform beyond its intended functionality.

7.3. The Portal and Mobile App are provided “as is”.

8. LIABILITY LIMITATION

8.1. The Administrator is not liable for:

  • damages or losses arising from use of the platform
  • actions of third-party service providers
  • technical failures or service interruptions

8.2. Access to the platform may be interrupted due to maintenance, force majeure or other technical reasons.

8.3. The Administrator welcomes suggestions from Users regarding improvement of the service.

9. FINAL PROVISIONS

9.1. This Agreement constitutes the entire contract between the User and the Administrator regarding use of the platform.

9.2. Any disputes shall be governed by applicable laws in the jurisdiction where the Administrator operates.

9.3. Consumer protection regulations may apply depending on local legislation.

9.4. This Agreement does not establish employment, partnership or agency relationship between the User and Administrator.

9.5. If any provision of this Agreement is deemed invalid, other provisions remain in force.

9.6. Failure of the Administrator to enforce any provision does not constitute waiver of rights.

9.7. By using the platform the User confirms agreement with Payment Policy and Cancellation Policy available on the Portal and Mobile App.
